DoD ONR Memorandum: Implementation of a 15% Indirect Cost Cap on Assistance Awards to Institutions of Higher Education

Dear Colleagues,
The Department of Defense issued a memo signed by Secretary of Defense Pete Hegseth on May 14, 2025 to cap indirect cost reimbursement rates for higher education institutions at 15 percent.
The memo directed the DOD to develop the new policy within 21 days, marking the fourth federal agency—including the National Institutes of Health, the Department of Energy and the National Science Foundation—that has enacted a plan to cap indirect cost rates at 15 percent.
So far, universities have been using their respective approved indirect cost reimbursement rates negotiated with the federal government to pay for research infrastructure support costs such as facilities maintenance and administrative personnel necessary to pursue research.
On Friday, June 13, 2025, Principal Investigators (PIs) on active research grants and contracts funded by the DoD Office of Naval Research (ONR) received emails stating that ONR is in receipt of DoD memorandum dated June 12, 2025 directing the implementation of a 15% indirect cost cap for future and existing DoD assistance awards with IHEs. The ONR email advised that an ONR representative would be contacting PIs about their ongoing ONR grant(s) in the near future.
In the DoD memo dated June 12, the following statements on negotiating the indirect costs for new and existing awards are provided:
“For all new assistance awards to IHEs, DoD Components that make financial assistance awards to IHEs are directed not to allow indirect cost rates above 15% in all new assistance awards to IHEs as of the date of publication of this memorandum. In negotiating indirect cost rates for financial assistance awards to IHEs, DoD Components should consider the criteria for identifying and computing indirect cost rates as described in Appendix III to 2 CFR Part 200. However, DoD Components must not exceed the 15% indirect cost rate cap on any award to IHEs. All notices of funding opportunity for DoD assistance awards must be updated to include information about the 15% indirect cost rate cap for IHEs. In addition, all DoD Components that make financial assistance awards to IHEs are reminded that they must ensure that all indirect costs on assistance awards are reported to the Financial Assistance Award Data Collection System, which is the Department's system of record for compliance with the Digital Accountability and Transparency Act of 2014.”
“For all existing assistance awards to IHEs, DoD Components must also apply the 15% cap on indirect cost rates. Where possible, DoD Components should renegotiate indirect cost rates on existing DoD assistance awards with IHEs to comply with the 15% indirect cost rate cap. The 15% indirect cost rate cap on existing assistance awards is not required to be retroactive to the beginning of an award but must have an effective date that is not later than November 10, 2025. DoD Components may allow existing awards to operate under their originally determined indirect cost rate until a renegotiation is completed. However, all renegotiations on indirect cost rates must be complete by no later than November 10, 2025. If a DoD Component is unable to reach an agreement with an IHE to limit the indirect cost rate under a DoD assistance award to 15%, the DoD Components shall terminate the assistance award, as allowed by statute, regulation, and the terms and conditions of the award, in accordance with 2 CFR 200.340(a).”

Industry calls for more research funding, public-private partnerships in the National AI Strategy: Private sector companies are asking the federal government to prioritize diverse investments across technology areas that inform the development of U.S. artificial intelligence systems, along with an effort to take the lead on standards development and to pursue industry-government partnerships. In comments sent to the Office of Science and Technology Policy and Networking and Information Technology Research and Development National Coordination Office, industry leaders in AI innovation — such as Google, IBM, Anthropic and Amazon — told policymakers what they would like to see in the forthcoming 2025 National AI R&D Strategic Plan. The four companies touched on several common themes, most prominent of which was the need for sustained federal investment in the myriad science and technology efforts related to AI systems. For Google, this means continued investment in algorithm and chip design, scaling advanced manufacturing infrastructure and workforce development. “The new Strategic Plan should launch a comprehensive initiative to educate America’s science students and scientific workforce on new AI technologies, supporting the uptake of AI as the next scientific instrument,” Google wrote in its comments. AWS GovCloud gets high-level security approvals for Anthropic and Meta AI models: Amazon Web Service’s government cloud service has achieved FedRAMP High and Department of Defense Impact Level 4 and 5 authorizations to host artificial intelligence software from leading companies Anthropic and Meta, AWS announced Wednesday. Anthropic’s Claude and Meta’s Llama AI foundation models are now cleared to operate in federal digital environments deemed high risk and handle corresponding sensitive, unclassified data. Public sector customers that make use of such sensitive data — such as those in the Department of Defense — will now be able to access both AI products for agency mission work. “With this achievement, AWS is expanding the potential for Meta’s open source Llama models to power mission-critical applications in secure or disconnected environments at a lower cost,” Molly Montgomery, the director of public policy at Meta, said in a press release. Specific versions of Anthropic and Meta’s AI models with this FedRAMP authorization include Claude 3.5 Sonnet v1, Claude 3 Haiku, Llama 3 8B and Llama 3 70B. Some of the tasks they are intended to handle include simplifying compliance between application programming interfaces and building and customizing AI models based on these foundations. IBM bets on novel error-correction for scalable quantum computing: IBM announced a new quantum error correction architecture Tuesday that will characterize the design of its forthcoming large-scale quantum processor, IBM Starling. The starring element of IBM’s Quantum Starling, slated to arrive by 2029, is the low-density parity-check code — in which many logical qubits may be encoded on fewer physical qubits while reducing noise interference — that facilitates the error correction necessary for a quantum-powered computer to smoothly process information and execute commands. Abbreviated as LDPC, the error-correcting coding method is the star element of IBM’s novel fault-tolerant architecture, dubbed “the bicycle architecture.” As opposed to surface code architecture — which encodes information on a two-dimensional lattice of qubits, often in short-range — IBM’s bicycle architecture promises better error correction and reliable performance abilities through coupling LDPC codes with modular hardware that supports long-range qubit connectivity, with the goal of enhancing Starling’s computational capacity to fault tolerance.
